Because if they lose it sets a precedent!
Apparantly banks aren't allowed to 'fine' customers for unauthorised overdraughts and the like. They can only charge a 'reasonable' fee, which can only cover costs. If customers take a bank to the small claims court claiming the charges are unreasonable, the banks wont show and the customer wins by default. The banks do this because if they did show, and lost, then it would set a precedent. P.S. This information was published in the Sunday Times a few weeks ago, and may only apply in the UK. |
