From what I heard on the radio last Friday, Lay's death vacates the conviction and, since he was never sentenced, expunges his record, such as it is, of any conviction. That may be, but I don't think it saves the estate. I'm pretty sure that someone can go after an estate after someone dies. They might have to re-present the evidence to make the case for recovery against the estate, but I don't think his estate is "home free." Since the sentence was never imposed, the government has no means by which to seize his remaining estate, estimated, now, at some $US8E6.
I wasn't aware that he'd been fined so much as to reduce his estate to so little. It was probably the cost of his legal defense that did it. Wow, I didn't realize it was that low either. That might be low enough so that the victims don't bother to go after it because, divided up, there's not much to go after. There were marginally-believable theories that Lay decided to check out early since he was going to die in prison and his family would have lost his estate anyway; the thought being that he may have "arranged" for his untimely demise so that at least his family might preserve his estate. I'm not one to put much belief in conspiracy theories and Lay didn't strike me as someone that would make that sacrifice, even for his family. But considering how little of the estate is left, it seems pretty obvious there was no motive for him to go for early departure. That said, considering how small his estate is now, I wonder how much of it is actually floating around in unnumbered accounts in certain countries that value the privacy of their financial clients?
